I. INTRODUCTION

This Amicus Curiae Brief is submitted in support of Plaintiff Darrell Leon McClanahan III’s

Complaint challenging the constitutionality of Executive Order 13899 and its expanded application. The undersigned Amicus Curiae, Eli James, a minister of the Christian Identity faith, submits this brief pursuant to Federal Rule of Civil Procedure 24 and Missouri Rule 375, asserting a significant interest in the legal issues presented and offering unique perspectives that may assist the Court in its determination.

II. INTEREST OF AMICUS CURIAE

Eli James is a minister of the Christian Identity faith, a belief system that holds specific interpretations of biblical scripture related to the identity of the descendants of ancient Israel.

As a preacher, he has a deep concern for the preservation of religious freedom and the right to express his faith without undue government interference. Just as important is the fact that no private party or other religious denomination has the right to suppress dissenting religious opinions. The Amicus Curiae believes that the issues raised by Plaintiff’s Complaint have significant implications for the free exercise of religion and the right to express deeply held beliefs.

III. ARGUMENT

The following sections of this Amicus Brief are based on President Trump’s public proclamations concerning so-called “anti-Semitism.”  I use the word ‘so-called’ advisedly, because without a clear, concise and unequivocal definition of ‘Semitism,’ there can be no clear definition of ‘anti-Semitism.’   Every judge and lawyer knows that law must be based on clear precise terminology regarding both legal and common language.

 

A. The First Amendment and Religious Liberty

The issue here is whether there is Freedom of Speech for “Anti-Semites”

1.) Donald J. Trump, as President of the United States and Commander-in-Chief of our military, must put the interests of the American people before any other nation or foreign pressure group within our nation. To do otherwise is to flagrantly violate the treason clause of the Constitution.  Since America was founded as a Christian nation with the Americans using the slogan, “No King but Jesus,” it is ironic that the Jewish lobby demands that we not criticize their religion, which does not recognize Jesus Christ as the biblical Messiah.

2. Executive Order 13899, by targeting speech critical of Israel and Judaism, directly impacts the ability of individuals to express their religious beliefs, including those related to Christian theology.

3. All Ethnic Groups Have the Right to Exist Without Oppression from Other Groups.

No one denies that the Jewish people have a right to exist.  At the same time, the Israeli government has been prosecuting a genocidal war against the Palestinian people, who have resided in Palestine since the destruction of the Jerusalem Temple in 70 AD.  These Palestinians have resisted the takeover of their country by the invading Zionists since the enactment of the Balfour Declaration, which was issued by the British Cabinet in 1917 without the knowledge of Parliament nor the British people. This was a semi-secret deal made strictly between the Zionists and the British Cabinet.

4. Chauvinistic tactics of the Zionist state.

In the name of “fighting against Hamas,” Israeli Prime Minister Netanyahu and his rabbinically fundamentalist cohorts have leveled virtually all of Gaza, destroying over 55,000 Palestinian structures since 2022, usually while these poor and defenseless people were still within their dwellings.  This includes the destruction of hospitals, schools, nurseries and nursing homes, as well as ambulances, plus killing foreign volunteer doctors and nurses, and journalists.  Who Speaks for the Palestinian people?  Jewish censorship prevents them from getting any publicity.

 

5. Zionism Violates Biblical Law

Right after WWII, America had no enemies in the middle East.  We had nothing but good relations with the Arab world, especially because American oil drilling technology was helping the Arab states to prosper, beyond their wildest dreams, from their rich oil deposits.  However, since the creation of the Israeli State in 1948, the Jewish lobby has proceeded to make war against virtually every other nation in the Middle East, from Syria to Iran to Yemen, so that the Jews can promote their supposed “biblical” claim to these lands.   Hundreds of thousands, if not millions, of goyim (non-Jews) have lost their lives and property in the never-ending Jewish wars against the peoples of the Arabian Peninsula. This is the true cause of resistance to the Zionist state. America should not be taking sides against such victims of Zionist oppression.

 

B. What Is a Semite?

Before we can determine what “anti-Semitism” is, we must have a clear definition of what a Semite is.

The Jews claim to be descendants of Shem through Abram, based on Genesis 12:3, the very famous verse, “And I will bless them that bless thee, and curse him that curseth thee: and in thee shall all families of the earth be blessed.”   Judaism claims that “Abraham was  Jew,” even though he was Judah’s great-granddaddy.  Also, Judaism has created the false impression, by equating “anti-Semitism” with “anti-Judaism,” that Jews are the only Shemites left in existence.  Do any of these claims have historical or biblical merit?

According to the Bible, Abraham had three wives:  Sarah, Hagar and Keturah.  By these three women, the prophecy that Abraham would be the “father of many nations and companies of nations” was fulfilled.   Since biblical descent is reckoned through the father, this means that, as a descendant of Shem, all of Abraham’s descendants — not only Jews — are Shemites.  Hagar bore Ishmael, the patriarch whose descendants today are known as Arabs.  The Arabs also reckoon themselves Shemites through Abraham. Keturah bore 6 sons (Gen. 25:1-4).   Because of the Bible’s clear patriarchal reckoning, Keturah’s sons were/are also Shemites.  They were sent east towards the Euphrates, where they settled, being most probably the ancestors of the Iranians, who do not consider themselves to be Arabs.  One of these sons was Midian, who was the ancestor of Jethro, whose daughter, Zipporah, Moses married.  They had two children Eliezer and Gershom, also Shemites.

Jewish rhetoric regarding Abraham asserts that only the Jewish people should be considered “Semites” via Abraham.  But the Jews are only one small nation and they are only one among many Shemitic nations descended from Abraham through his three wives.

By the way, the Israeli State ignores this patriarchal reckoning and has declared that an Israeli Jew is someone who has “a Jewish mother.”  Does Abraham fit in to this matriarchal equation?  Thus, we have to ask the question, “Who’s your daddy?”

Here is the definition of ‘Semite’ from the online Merriam-Webster dictionary:

1a : a member of any of a number of peoples of ancient southwestern Asia including the Akkadians, Phoenicians, Hebrews, and Arabs

b: a descendant of these peoples

2: a member of a modern people speaking a Semitic language

Most of the definitions that have been given by historians, linguists and theologians say much the same thing, so the idea that only Jews are “Semites” and that “anti-Semitism” involves only Jews is, to use a quaint term, a canard — deliberate abuse of language conceived by very subtle Talmudic Pharisees.

Given the fact that virtually all of the nations of the Middle East are descended from Abraham, the fact that the Jews are making war against these people means that the Jews themselves are the worst “anti-Semites” in the world.  How’s them apples, or should I say camels?

These are the clear historical and biblical facts.   The fact that the rabbis of Judaism claim to be the ONLY inheritors of the promises made to Abraham is thus proven to be an anti-Shemitic lie  of monumental proportions.

 

C. What Is a Jew?

The Jewish people are not a homogeneous group.  There are atheist Jews, Reform Jews, Orthodox Jews, Zionist Jews, anti-Zionist Jews, communist Jews and whatnot.  The most rabid — meaning chauvinistic and anti-goyim — of these enclaves is the Chabad Lubavitchers.  They are the most orthodox of all the orthodox:  radically orthodox.  These facts only cover the differences among Jews of religion and ideology.  In addition, there are Arabian Jews, Ethiopian Jews, Chinese Jews, Iranian Jews, Black Jews, White Jews, Moroccan Jews, Babylonian Jews, etc.  Jews and Judaism are a polyglot motley crew of radical left, radically Zionist, xenophobic religious zealots and sundry extremists who fight amongst themselves, as the street demonstrations and riots within the Israeli state attest.  Despite getting their long sought after Jewish State, Jewish agitation for exclusive Jewish rights within other nations constitutes an endless cause of strife in every country in which they dwell, including their own.

 

D. Fair Play for Dissenters

Ironically, the Zionists claim that since the Jewish people were expelled by the Nazis during WWII that this German policy gives Jews the right to expel the Palestinians, Syrians, Iranians and Arabs from their own homelands!!  What kind of logic is this?  Does the God of Israel support the idea that because Jews got kicked of one country that they can indiscriminately kick out the citizens of any other country?  This is a moral tragicomedy utterly lacking in jurisprudence.  Palestinians deserve justice too.  Exo 23:9  Also thou shalt not oppress a stranger: for ye know the heart of a stranger, seeing ye were strangers in the land of Egypt.

1. By suppressing criticism of Israel and Judaism, the Executive Order creates the potential for government endorsement of a specific religious perspective. The Founders would shudder at such an idea.

2. The plaintiff’s religious freedom is being violated as the government is enforcing a specific religious viewpoint. From President Trump’s White House Memorandum, dated January 29, 2025, entitled “Additional Measures to Combat Anti-Semitism,” we read,

Section 1.  Purpose.  My Administration has fought and will continue to fight anti-Semitism in the United States and around the world.  On December 11, 2019, I issued Executive Order 13899, my first Executive Order on Combating Anti-Semitism, finding that students, in particular, faced anti-Semitic harassment in schools and on university and college campuses.  Executive Order 13899 provided interpretive assistance on the enforcement of the Nation’s civil rights laws to ensure that they would protect American Jews to the same extent to which all other American citizens are protected.  

My response to this statement is that as long as the United States imports antagonistic alien groups, these groups will espouse their causes whenever they are brought into contact. Which cock do you favor in this cockfight? The Zionist State has made this struggle an international one, especially since the Palestinian cause has no voice in the international media nor in the halls of international justice. The right to dissent is an American tradition. Favoring one side over the other is a sure prelude to violence.

IV. CONCLUSION

For the foregoing reasons, Amicus Curiae Eli James respectfully requests that the Court grant the Plaintiff’s request for declaratory and injunctive relief. The Executive Order violates the First and Fifth Amendments, as well as the Establishment clause, and threatens the religious liberty of individuals like the Amicus Curiae and the Plaintiff.
